Introduction

These Terms of Service (“Terms”) govern your use of the travel services provided by TOSEECHINA (“we”, “us”, “our”) through our website https://www.toseechina.com or via direct interaction with our concierge team. By engaging our services, making a booking, or using our website, you (“Client”, “you”) agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations.

Please read these Terms carefully. If you do not agree with any provision, do not use our services.

1. Services Provided

TOSEECHINA offers high-end private travel concierge services, including:

  • Customized travel itineraries for first-time visitors (10–15 days) and in-depth regional experiences (7–10 days).
  • Arrangement of accommodation, private transportation, professional guides, cultural activities, and local experiences.
  • Personalized support from a dedicated travel concierge throughout your journey.
  • Assistance with travel logistics (visa guidance, itinerary adjustments, emergency support).

All services are tailored to your specific requests and confirmed in writing (via email or formal itinerary document) before implementation.

2. Booking and Payment

2.1 Booking Process

  • To initiate a booking, you must submit your travel requirements (dates, group size, preferences, special requests) via our website, email, or phone.
  • We will provide a detailed customized itinerary and quotation within 3–5 business days of receiving your request.
  • A booking is confirmed only after you accept the quotation and pay the required deposit (as specified in the quotation).

2.2 Payment Terms

  • Deposit: A deposit is required to confirm your booking and secure reservations (accommodation, activities, transportation), which is non-refundable.
  • Final Payment: The remaining balance must be paid no later than 30 days prior to your scheduled departure date.
  • Payment Methods: We accept credit card payments via Stripe (Visa, Mastercard) and bank transfers.
  • Late Payments: Failure to make the final payment by the deadline may result in cancellation of your booking, with forfeiture of the deposit.

2.3 Service Fees

  • The total service fee includes all items specified in the confirmed itinerary (accommodation, transportation, activities, guide services).
  • Excluded items: Visa fees, international airfare, personal expenses (shopping, meals not specified, gratuities), travel insurance, and unexpected costs due to client-initiated changes.
  • Fee Adjustments: We reserve the right to adjust fees if there are significant changes in costs (e.g., hotel price increases, government taxes) with prior written notice. You may cancel the booking if you do not accept the adjusted fee.

3. Client Obligations

  • Provide accurate and complete information (personal details, passport information, travel preferences, health conditions) to ensure smooth service delivery.
  • Obtain valid visas, travel insurance, and necessary vaccinations before your trip.
  • Comply with Chinese laws, regulations, and local customs during your journey.
  • Inform us of any changes to your travel plans or health conditions promptly.
  • Take responsibility for personal belongings and valuables during the trip.
  • Cooperate with our concierge team and local partners to ensure the itinerary is followed safely.

4. Our Obligations

  • Deliver services in accordance with the confirmed itinerary and agreed-upon standards.
  • Provide a dedicated travel concierge to assist with all aspects of your journey (pre-trip planning, on-the-ground support, emergency response).
  • Ensure all service providers (hotels, guides, transportation companies) meet our high-quality standards for safety and comfort.
  • Communicate any necessary itinerary changes (e.g., due to weather, government regulations) promptly and propose alternative arrangements.
  • Protect your personal data in accordance with our Privacy Policy.

5. Itinerary Changes

5.1 Client-Initiated Changes

Requests to modify the itinerary (dates, activities, group size) must be made in writing. Changes made 30+ days before departure may incur administrative fees. Changes made less than 30 days before departure may result in additional costs (charged by service providers) and are subject to availability.

5.2 Our-Initiated Changes

If we need to change the itinerary due to circumstances beyond our control (force majeure, safety concerns, partner service disruptions), we will notify you immediately and offer a reasonable alternative. If no alternative is acceptable, you may be eligible for a refund in accordance with our Refund Policy.

6. Liability

We are liable for direct damages caused by our negligence or failure to fulfill agreed-upon services.

We are not liable for:

  • Damages due to force majeure (natural disasters, political unrest, pandemics, government restrictions).
  • Personal injury or property loss caused by third-party service providers (we will assist in resolving disputes with partners).
  • Delays or disruptions due to factors beyond our control (flight cancellations, traffic accidents, weather).
  • Losses caused by inaccurate information provided by the client.

Our total liability shall not exceed the total service fee paid for the booking.

7. Termination

  • We may terminate services if:
    • The client breaches these Terms (e.g., late payment, failure to provide accurate information, disruptive behavior).
    • Continuing services would violate legal requirements or pose a safety risk.
  • The client may terminate services in accordance with our Refund Policy.

8. General Provisions

  • Governing Law: These Terms are governed by the laws of China.
  • Dispute Resolution: Disputes shall be resolved through negotiation. If negotiation fails, disputes shall be submitted to the competent court in Beijing, China.
  • Amendments: We may update these Terms with prior written notice. Your continued use of services after updates constitutes acceptance.
  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and TOSEECHINA, superseding all prior agreements.
